ABSTRACT
This research examines the system of succession to rights in land under the Igala customary law of Kogi State, Nigeria. Succession to land remains a crucial aspect of customary law, influencing inheritance, gender relations, and social justice. The study critically analyses the traditional rules guiding inheritance among the Igala people, identifies the patterns of intestate succession, and assesses how customary norms align or conflict with Nigerian statutory law and constitutional provisions. Using a doctrinal method supplemented by field interviews, the study finds that while Igala customary law provides a structured mode of succession often patrilineal it raises human rights concerns regarding the exclusion of women and certain social groups. The thesis concludes by recommending a reform model that harmonizes cultural traditions with constitutional guarantees of equality.
